Today December 15, 2007 Musharaf the president of Pakistan Musharaf lifted the emergency in the country. The emergency was imposed for 41 days. The main objective of emergency was to save the president position and corner the top judges of Pakistan supreme court.

The judges which are performing their duties are working after taking oath under PCO. Now the judges will take again new oath under the constitution because by lifting the emergency in the country the constitution will prevail. During the emergency rule the President did amendments in the constitution which few political parties refuse to accept. The amendments were totally on personal benefit of Musharaf.

Today president Musharraf will address the nation and try to convince the peoples on his illogical actions imposed on the country.

According to Wikipedia A state of emergency is a governmental declaration that may suspend certain normal functions of government, may work to alert citizens to alter their normal behaviors, or may order government agencies to implement emergency preparedness plans. It can also be used as a rationale for suspending civil liberties. Such declarations usually come during a time of natural disaster, during periods of civil unrest or in a situation of war.

Many countries have state of emergency law in their constitution like  Germany, USA, India, spain, China, Hong Kong, Pakistan and many more. More or less the law depicts the same picture as defined above.

Pakistan has just enforced it and now Pakistan is observing a state of emergency. In Pakistan law the emergency can be imposed in such a condition where there is political unrest in the country or any province or part of the country. The emergency can be declared either in the whole country or in a part or province.

If the emergency has declared in the whole country then each part of the country becomes under the federal govt regulations. The federal government is above any law of provices and the provinces have to follow the federal. There must be the justification of emergency.

According to the consttution the emergency can be challenged in the supreme court like it was challenged in 1998 when Pakistani tested the nuclear. At that time the Nawaz Shareef was the prime minister of Pakistan.  The supreme court bench gave verdict in which the emergency was justified but the basic rights of the peoples had to be normal.

In the current situation the government of Pakistan declared the state of emergency not of any above reasons rather it has been declared due to differences with supreme court.
